TERMS & CONDITIONS

These Terms and Conditions apply to all Riding Argentina’s tours.

PLEASE READ CAREFULLY

The purchase of any travel services offered by Riding Argentina constitutes a contractual arrangement between the traveler (“you”) and Riding Argentina, and represents your acceptance of Riding Argentina’s Terms and Conditions set out herein. If various travelers are listed on one booking form, these terms and conditions apply to each of them; and the person signing the booking form warrants that he/she has full authority on behalf of all the persons whose names appear thereon, and confirms that all such persons are fully aware of and accept these terms and conditions. Please ensure that you read carefully and understand these Terms and Conditions prior to booking. These Terms and Conditions are subject to change after the publication of the tour information. You are advised to check on the web site or to request the latest version of the Terms and Conditions from your Travel Agent or Riding Argentina prior to booking your vacation. Clients booking by telephone, facsimile or email will be deemed to have read the Terms and Conditions.

How to Make a Reservation
A reservation has to be confirmed by Riding Argentina in order to be valid.

Standard Deposit & Final Payment
We accept bank transfers and money orders. The transaction costs of any bank transfer or money order should be assumed by you. Your payment is not deemed made until it is received by Riding Argentina. A non-refundable, non-transferable deposit of 30% of the total amount due is required for us to make a reservation. Your booking is not confirmed until the deposit is received by Riding Argentina and you receive a confirmation invoice. Your reservation will be automatically canceled if the deposit is not received by Riding Argentina within four (4) days of booking. On request, you will provide proof of payment to Riding Argentina. On certain departures, additional deposits may be required at time of booking to hold or to confirm space for you. Please review and verify your booking invoice thoroughly and contact your Travel Agent or Riding Argentina immediately if your invoice appears to be incorrect or incomplete, as it may not be possible to make changes later. Riding Argentina cannot accept responsibility if we are not notified of inaccuracies within 10 days of sending out the invoice.

Final payment of the remaining balance is due 45 days prior to commencement of services. If we do not receive final payment by the due date, we reserve the right to cancel the reservation and retain your full deposit. We are not responsible for canceled land or air reservations in the event payment is not received by the final payment date. Payment in full is required at time of booking for reservations made within 45 days of departure.

Changes and Cancellations
Any costs or charges, which we incur or which are incurred or levied by our suppliers as a result of a change to the booking requested by you, will be charged to you. Whilst every reasonable effort will be made to accommodate changes and additional requests, their availability cannot be guaranteed.

If a written cancellation is received by Riding Argentina before the final payment date of your vacation, your non-refundable deposit will be retained. If Riding Argentina is notified of a cancellation between 45 and 9 days before departure, Riding Argentina will retain 75% of the total amount paid. If a cancellation is received within 8 days of departure, the full amount will be retained. In addition to these charges, airlines may impose up to 100% cancellation charges. In case part of a booking is cancelled, the remaining party may have to pay additional charges (e.g. under-occupancy, or single room supplements).

If any member of your party is prevented from traveling, it may be possible to transfer the booking to another suitable person, provided that written notice is given at least 30 days prior to departure. An administration fee of 50 US$ will be levied plus any costs imposed by Riding Argentina’s suppliers. Airlines may impose 100% cancellation charges and the cost of a new ticket.

Changes and Cancellations by Riding Argentina
If a specific tour operates with a minimum number of participants, Riding Argentina reserves the right to cancel such trip before it is guaranteed to run in case the number of participants is less than the stated minimum.

Although every effort will be made to keep itineraries and hotels as they are shown, Riding Argentina reserves the right to substitute itineraries, hotels, transportation or vessels. In such cases, we will do everything we can to make sure the locations visited, the excursions taken and the hotels or vessels offered are similar to the ones originally planned. We reserve the right to substitute alternative transport or accommodation in the interests of the safety of our passengers and/or the successful completion of the itinerary. Any changes to itineraries will not result in eligibility for a refund. Itineraries are subject to change without notice and may need to be altered specifically because of weather or other conditions. Riding Argentina accepts no liability for loss of enjoyment as a result of these changes. No refunds will be made for any part of the program in which you choose not to participate.

In case of a major change in the trip, you will be informed of such change at the time of the reservation, or, if it only becomes clear after having made the reservation, as soon as reasonably possible. When a major change is made you will have the choice of accepting the change of itinerary, purchasing any other available tour or canceling the tour and obtaining a full refund, provided that the major change is not because of force majeure.

Force majeure is war, threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline or aircraft type, or other similar events beyond the control of Riding Argentina. Riding Argentina is not liable for any charges in the event of a change -beyond its control- to the departure time or date of a tour, flight or other form of transport.

Riding Argentina is not responsible for any incidental expenses that you may have incurred as a result of your booking such as visas, vaccinations, non-refundable flights or loss of enjoyment, etc. If an alternative trip chosen is of a lower value than that originally booked then you are entitled to a refund of the price difference. If the alternative tour chosen is of a higher value then you will pay the difference in price.

Flight Arrangements
Riding Argentina is not responsible if an airline cancels, reschedules, or delays a flight for any reason. If you miss your flight, it is your responsibility to work with the airline on which you are ticketed to reach your destination. Riding Argentina is not responsible for any additional expenses you may incur. Riding Argentina is not responsible for and will not provide any refund for portions of trips missed due to canceled, rescheduled, or delayed flights.

Riding Argentina will use its best efforts to quote flight prices that are valid at the time given. However, airlines reserve the right to change fares without prior notice. The payment of a deposit guarantees your reservation of the flight, but it does not guarantee the price of the flight. In order to guarantee the fare, you should pay the full amount of the flight prices and a ticket has to be issued.

Flight times as presented by Riding Argentina are for general guidance only and are subject to change. Up-to-date flight times will be shown on your tickets. You should check the tickets very carefully immediately upon receipt of the latest timings. Riding Argentina will endeavor to inform you as soon as possible in the event of any flight alteration. Details of airlines are also subject to change. Such alterations do not constitute a significant change to the holiday arrangements and you will therefore not be entitled to cancel without paying the normal charges as a result.

Your air carrier may have weight/dimension limitations. Size and weight limitations for carry-on and checked baggage vary from airline to airline and even according to destination.  Some airlines are also charging fees for additional checked baggage, including the first checked bag, and these fees are not included in the vacation package. Please check with your airline directly for baggage information and regulations. Riding Argentina is not responsible for any additional fees imposed by air carriers regarding baggage. Regulations within most airports require that travelers handle their own luggage through customs. No responsibility is accepted for loss of or damage to baggage or any of the traveler’s belongings throughout the duration of the vacation. Baggage insurance is recommended.

Changes in Departure and Arrival Times
Airlines, bus companies, cruises and other tour operators tend to change departure times, even on short notice. Therefore, you should always confirm the departure time of any flight, cruise, bus transfer or other tour within 24 hours of the scheduled departure. Arrival times are always estimates and the actual arrival time may vary from the expected arrival time.

Travelers Who Need Special Assistance on Tours
You must report any disability requiring special attention while on tour to Riding Argentina at the time the reservation is made. Riding Argentina will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so nor is it responsible for any denial of services by air carriers, hotels, restaurants, or other independent suppliers. Most transportation services, including the touring motorcoach, are not equipped with wheelchair ramps. We regret that we cannot provide individual assistance to a vacation participant for walking, dining, getting on and off motorcoaches and other vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance and must assume full responsibility for their well being.

Young Travelers
Travelers who are less than 18 years old on the departure date must be accompanied by an adult throughout the duration of the vacation. For any special requirements regarding airline tickets for children, contact your airline directly.

Due to heightened security, many countries have adopted practices to prevent international abductions of children. If a child will be traveling with adults other than the parents or with only one parent, it is recommended that a notarized letter be written by the parents or non-traveling parent granting authorization to travel, including the dates of travel. We suggest that you also contact the appropriate consulate and airlines because they may have additional requirements or recommendations.

Smoking
Smoking is not allowed on transportation that is exclusively provided by Riding Argentina. As a standard rule, Riding Argentina confirms non-smoking hotel rooms.  If you require a smoking room a request may be submitted, but we cannot guarantee availability.

Prices
All vacation prices are based on rates (reflecting foreign exchange rates) known at the time of publication and expected to be in effect at the time of departure, and do not include airfare unless indicated. Vacation prices are per person, based on double occupancy. Single room supplements and triple room reductions may be applicable and should be requested. Not all accommodation types are available on all vacations. Prices are subject to increase without notice.

Prices do not include meals other than indicated in the travel details. Not included in the price are cost of passport and visas; vaccinations, excess baggage charges; airport and port taxes; laundry; minibar; telephone; all items of a personal nature; food, beverages, wine or liquor, unless indicated; items not included on regular menus; expenses for additional sightseeing not specified in the itinerary; gratuities; and health, accident, baggage, or travel protection plans.

Visas & Passports

You are responsible for obtaining and paying for all visas and entry documents, for meeting all health and other requirements, and for any documents required by law, regulations, orders, and/or requirements of the countries you will visit. At any time during your holiday, you should carry  your passport with you. You should consult with appropriate consulates to determine if any visas are needed and are responsible for obtaining all visas and entry documents independently. Riding Argentina is not responsible for providing you with specific visa and passport information or documentation and Riding Argentina cannot accept liability for any passenger refused entry onto any transport or into any country due to failure of the passenger to carry correct documentation or a failure to pass medical examination. It is your responsibility to verify all visa, passport and health requirements.

Service Inquiries after the Vacation
Any complaint or claim involving the vacation services offered must be notified to Riding Argentina within 14 days of the tour completion.
As it is difficult and sometimes impossible to properly investigate a complaint if we are not advised of such complaint quickly, any compensation you may have been able to claim could be reduced or even forfeited if you do not follow the complaints procedure set out in this clause.

In the event of a problem or complaint involving the negligence of any of our suppliers, sub-contractors, or agents in relation to any service provided to the vacation participant, we must receive the complaint at the earliest possible time, possibly while on the tour.

Holidays
During local or national holidays or special events, on Sundays, and religious occasions, certain facilities such as museums, churches, restaurants, sightseeing tours, and shopping may be limited or not available. Alternatives will be offered whenever possible. Riding Argentina cannot be held responsible for any closures or curtails for any reason.

Safety
Horseback riding is not without dangers. You should be fully aware of the same and Riding Argentina does not accept any responsibility in this respect. Some of our tours require experience in horseback riding and you should carefully review if your level of experience is in line with the required level for the chosen tour.

Please be aware that during your participation in vacations operated by Riding Argentina, certain risks and dangers may arise beyond our control, including but not limited to: the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; the forces of nature; political unrest; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation or medical facilities. Riding Argentina will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Riding Argentina will use its best efforts to ensure that adequate measures are taken.

In case of medical problem arising during the trip, which results in costs for evacuation, use of aircraft or repatriation, the responsibility for payment of these costs belongs solely to you. You must be covered by travel insurance policy that includes emergency evacuation and repatriation. If not covered by travel insurance the responsibility still remains with you and Riding Argentina declines any responsibility whatsoever.

Conduct
For the benefit of everyone on your vacation, Riding Argentina reserves the right to accept or reject any vacation participant and to remove any participant whose conduct is deemed incompatible with the interests of the other participants. We will not refund nor cover any cost or expenses you incur if we have to terminate your vacation arrangements due to your unacceptable behavior.

Photographs or pictures appearing in this brochure should be used solely as an indication of facilities and attractions. Actual facilities and attractions may vary according to itinerary. Maps shown on the vacation pages are current at the time of printing and may not reflect the actual tour routing should the itinerary change.

Omissions
Riding Argentina is not responsible for omissions, printing and/or presentation errors in brochures, on Internet sites or in any other media where such information may be presented; we reserve the right to make corrections as required.

Responsibility
The air carriers, accommodations, and other suppliers (including but not limited to trains, cruises, ferries, motorcoaches, other transportation services, hotels, and restaurants) providing services are independent contractors and are not agents, employees, servants, or joint venturers of Riding Argentina or its affiliates. All certificates and other travel documents for services issued by Riding Argentina are subject to the terms and conditions specified by the supplier, which are available upon request, and to the laws of the countries in which the services are supplied.

The international carriage of passengers is subject to international conventions and treaties, where applicable. These international agreements limit and, in some events, exclude the carrier’s liability to passengers (vacation participants). Where any claim or part of a claim (including those involving death or personal injury) concerns or involves any travel arrangements (including the process of getting on or off the transport concerned) provided by any air, sea, inland waterways, rail, or road carrier or any stay in a hotel, Riding Argentina’s maximum liability is the maximum which would be payable by the carrier or the hotel keeper concerned under the applicable international convention, treaty, or regulation applicable to the travel arrangements or hotel stay (e.g. the Warsaw Convention, the Montreal Convention for international travel by air, the EU Regulation on Air Carrier Liability for carriers with an operating license granted by an EU country, the Athens Convention for international travel by sea) in that situation.

After departure, if the services included in the vacation cannot be supplied or there are changes in an itinerary for reasons beyond the control of Riding Argentina, Riding Argentina will arrange for the provision of comparable services. Any resulting additional expense will be the responsibility of vacation participants, and any resulting savings will be refunded by Riding Argentina to vacation participants.

Riding Argentina reserves the right to accept or reject any person as a vacation participant; to expel any participant from the vacation; to make changes in the itinerary whenever Riding Argentina deems it necessary for the comfort, convenience, or safety of the participants; and to cancel a vacation at any time.

The vacation participant agrees that neither Riding Argentina nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss), or expense occasioned by any act or omission of any supplier providing services, or any other person.

Any dispute between the vacation participant and Riding Argentina directly or indirectly relating to the Terms and Conditions must be resolved by binding arbitration under Argentine law before the Courts in the City of Buenos Aires.

Arbitration against Riding Argentina must be commenced within one year following the date of tour completion. Neither Riding Argentina nor any affiliate shall in any case be liable for other than compensatory damages, and you hereby waive any right to punitive damages.

No person, other than an authorized representative of Riding Argentina by a document in writing, is authorized to vary, add, or waive any term or condition in its tour information or on its Web site, including any term or condition set forth in the preceding provision
